1. Acceptance of terms and conditions and use of the site

1.1 By accessing and using our site, whether or not you register as a user (herein "user" or "you"), you agree to be bound by the Terms and Conditions of sale and use of the site, which you acknowledge having read and understood.

1.2 These Terms and Conditions of sale and use of the site (including any specific Terms and Conditions of use applicable to certain services) constitute the entire agreement between you and Blooming Vibes by Fontannaz (herein "Blooming Vibes" or "we").

1.3 By placing an order on www.bloomingvibes.com, you agree to the Terms and Conditions (terms of use) between you and Blooming Vibes. These Terms and Conditions apply to any purchase made on www.bloomingvibes.com.

1.4 Use of the site is authorized and dedicated to private use only. Any commercial use of products purchased on the site is strictly prohibited, including resale to third parties. 

1.5 We reserve the right to modify or change these Terms and Conditions at any time and without notice. It is your responsibility to keep yourself informed of any changes. Your continued use of the site following any changes will mean that you accept the changes 

1.6 The Terms and Conditions and the use of the site, as well as the relationship between you and Blooming Vibes, are governed by the Swiss substantive law. 

1.7 By accepting these terms of use, you declare that you are at least the age of majority in your country of residence.

2.  Obligation of registration

2.1 By registering, you certify and warrant that you are authorized to open an account in accordance with the Terms of Use and that the information you provide during registration is correct and true.

2.2 You agree to provide true, accurate, current and complete information about yourself and to maintain and update the registration data to keep it true, accurate, current and complete. If you provide any information that is untrue, inaccurate, not current or incomplete, or otherwise fail to comply with any provision of these Terms of Use, Blooming Vibes reserves the right to terminate your account or refuse any and all current or future use of the site without justification.

3. Account and security 

3.1 You are responsible for the quality and confidentiality of the password you choose when you register, and for all activities that occur under your password or account. Your password can be changed at any time in your account.

3.2 You agree to immediately notify Blooming Vibes of any unauthorized use of your password or account and/or any other breach of security. You ensure to disconnect your account at the end of each session by means of the button "logout" in your account. Blooming Vibes will not be liable for any loss or damage arising from your failure to comply with these terms and conditions. 

4. Content 

4.1 The content on the site is provided to you as is and may not be used, reproduced, distributed, transmitted, broadcast, performed, sold or otherwise exploited other than for viewing and use on the site. For this sole and exclusive purpose, Blooming Vibes authorizes you to access and use the site for private use in accordance with the Terms of Use. If you wish to copy or reproduce any of the content of the site for any other purpose, please contact us at hello@bloomingvibes.com.

4.2 The user agrees not to violate any legal norms, nor to use the site for any illegal purpose that could damage the system, data and/or personal information.  

5. Articles

5.1 The articles are available on the site during the period of sale and depending on available stocks. If in the event of delay in the process of preparation of the orders, the article is no longer available , Blooming Vibes can at any time cancel the order and refund the user of the amount which would have already been paid. 

5.2 Please note that the represented colors of the articles can differ from the real color.

6. Sales and payments

6.1 In accordance with current Swiss legislation, Blooming Vibes by Fontannaz is not subject to value added tax (VAT). Consequently, the prices indicated on the site are net prices, VAT not being applicable to the items offered for sale. To the prices indicated must be added the delivery charges shown in the basket. The prices of our products are subject to change without notice.

6.2 By clicking on "buy" you give your consent for the order of the articles selected in the shopping cart. The sales contract is validly concluded upon receipt of the order confirmation email, subject to the availability of the item.

6.3 The amount of purchases made on the site is due at the time of ordering, without discount. Payment is made by credit card (Visa, Mastercard, American Express), Twint, Google Pay and Apple Pay.

6.4 Blooming Vibes does not have access to the confidential information relating to the means of payment. The collected information is encrypted and transmitted to the company Stripe in a secure manner, without us having access. For more information, please see our data protection policy.

7. Deliveries

7.1 The articles are sent to the delivery address indicated by the user at the time of the order. 

7.2 We deliver only in Switzerland and Liechtenstein.

7.3 The shipping costs are handled and paid by Blooming Vibes for any order higher than 100 CHF (hundred Swiss francs). For any order lower than 100 CHF (hundred Swiss francs):

• a cost of 7.00 CHF (seven Swiss francs) applies for Economy shipments.
• a cost of 9.00 CHF (nine Swiss francs) applies for Priority shipments. 

Delivery times are two (2) to four (4) business days for Economy and one (1) to two (2) business days for Priority. 

7.4 Blooming Vibes is not responsible for any delays or problems in delivery. We are relieved of all responsibility upon deposit of the product to the Post Office. 

8.  Discount codes

8.1 The discount codes are not cumulative with other discount codes. They can neither be exchanged nor refunded. In case of cancellation of the sale or return, only the amount actually paid will be refunded. The discount code will be deducted from the amount refunded if the condition is no longer met. Discount codes cannot be reactivated.

8.2 Discount codes are not valid on products already on sale or on promotion.

9.  Warranty

9.1 The items offered on the website www.bloomingvibes.com are not covered by any warranty.

9.2 Material or manufacturing defects must be reported to our customer service within 14 (fourteen) days after receipt of the goods. When returning goods, the defective items must be mentioned on the return form. After this period, we will not accept any return.

10.  Right of return and refund

10.1 Items ordered can be returned within 14 (fourteen) days after receipt, in their original packaging and with all related labels. We will only take back items that are undamaged, unworn, with the corresponding return form. In case we notice a deterioration of the goods, we are entitled to keep a part or the whole amount paid, according to our discretion. Returns are at your expense, the post stamp being proof of the return. We recommend you to send your parcel with a tracking number, Blooming Vibes will not be held responsible in the event of loss or damage. 

10.2 Final sale conditions apply to select items and when specific discount codes are used. All purchases made with these conditions are non-returnable, non-refundable and non-exchangeable. Please carefully review the product details and the terms of any discount code before completing your purchase. If you have any questions or need clarification regarding a specific item or discount code, please do not hesitate to contact our customer support.

Some items are final sales. Be sure to check the product description for the mention "no return possible" or "final sale".

10.3 Beyond the 14 (fourteen) days, a return is unfortunately not possible anymore, Blooming Vibes reserves the right to refuse a return apart from the time limit.

10.4 In the event of a return, please send an email to: hello@bloomingvibes.com and we will send you a return form, as well as the instructions to follow. Items returned to us without a return request will not be accepted. 

10.5 Upon receipt and inspection of the items, you will receive a refund. The refund will be made via the same payment method you used to place the order. Please note that we do not refund shipping costs or any return shipping costs. 

11.  Comments and reviews 

11.1 By posting a comment or review, you agree that we may, at any time and without limitation, delete, edit, copy, publish, distribute, translate, and/or use in any medium, the comments you provide. We are and will be under no obligation to keep any comments and reviews confidential, we will not pay compensation for any comments and notices, or be obligated to respond to any comments and reviews. You agree that your comments and reviews do not violate any rights of any third party, including copyrights, privacy, publicity or any other personal or proprietary rights. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, and will not contain any computer viruses or other malicious software that could in any way affect the proper functioning of the service. 

12.  Copyright and intellectual property 

12.1 The Blooming Vibes name, logo, slogan, images and all content on www.bloomingvibes.com are protected by copyright and trademark laws. Any use of them is strictly prohibited and may be prosecuted.

13.  Termination

13.1 We may at any time with or without notice terminate your access to all or any part of the site and disable your account and all related information if you fail to comply with any of the Terms of Use. This can be done without justification.

14.  Indemnification 

14.1 You agree to indemnify and hold harmless Blooming Vibes and its partners and employees from and against any and all losses, damages, claims, penalties, fines, costs and expenses, including attorneys' fees, that may arise from your unlawful use of or your failure to comply with any provision of the Terms of Use.

15.  Violation 

15.1 Please report any violations of the Terms and Conditions of sale and use of the site to our customer service department at hello@bloomingvibes.com.

16. Applicable law and place of jurisdiction 

16.1 These general Terms and Conditions of sale and use of the website are binding between the seller and the buyer and are subject to the applicable Swiss law. Any dispute arising in connection with the general Terms and Conditions of sale and the use of the website shall be settled by the District Court of Morges (Switzerland). The goods remain the property of Blooming Vibes until full payment of the order by the buyer.

17.  Changes to the Terms of Use

17.1 You can view the most recent version of the Terms of Conditions at any time on this page. We reserve the right, at our sole discretion, to update, modify or replace any part of these Terms of Use by posting updates and changes on our site. It is your responsibility to periodically check our site for changes
